She said that the professor and teacher unions lack legal standing.
District Judge Mary Kay Vyskocil dismissed a lawsuit brought against President Trump’s administration by two university unions, She said that the unions did not have the grounds to sue the president’s administration for financial cuts to Columbia University.
The American Association of University Professors and the American Federation of Teachers filed suit against the administration after the Department of Education rescinded millions of dollars in federal funding when Columbia University refused to implement a number of policy changes requested by the administration.
Judge Vyskocil stated that the unions were unable to demonstrate that the action was federal retaliation, ruling that their suit did not prove that the removal of funding was “merely the ‘predictable’ response” to refusing White House directives.
“Our democracy cannot very well function if individual judges issue extraordinary relief to every plaintiff who clamors to object to executive action,” Judge Vyskocil wrote.
“If any funds have been wrongfully withheld, such funds may be recovered at the end of a successful lawsuit by the appropriate plaintiff in an appropriate forum,” she added. “It is not the role of a district court judge to direct the policies of the Executive Branch first and ask questions later.”
As the Lord Leads, Pray with Us…
- For wisdom for federal judges as they hear cases against President Trump’s actions.
- For the president and his Cabinet officials as they seek to prevent anti-semitism and discrimination on college campuses.
